Kabayan Remit Rewards Program – Terms and Conditions

Welcome to the Kabayan Remit Rewards Program (“Program”). By participating in this Program, you agree to abide by these Terms and Conditions as in force from time to time. Kabayan Remit reserves the right to modify these Terms and Conditions at any time, with or without notice.

The Program is open to all Kabayan Remit customers who create a transaction or refer a friend. Enrollment in the Program is automatic upon making a transaction or referring a friend.

• Transaction: Any remittance to the Philippines created by a validly registered customer using Kabayan Remit’s online services (web and mobile app only).
• Referral: Recommending a friend who successfully completes their first transaction using the customer’s referral link.
• Points: The currency earned through transactions and referrals, which can be redeemed for rewards.
• Parties: Refers to the Remitter and Kabayan Remit

The Program consists of three tiers based on the number of points accumulated:

• No redeemable rewards.

• 15% off a transaction fee with a cost of 400 points.
• 25% off a transaction fee with a cost of 600 points.
• Bronze Seasonal reward (raffle): One entry per 500 points (i.e. 5 transactions created or 5 referrals made). Automatic entry with no point cost incurred.

• 15% off a transaction fee with a cost of 400 points.
• 25% off a transaction fee with a cost of 600 points.
• 50% off a transaction fee with a cost of 1,100 points.
• Silver Seasonal reward (raffle): One entry per 500 points (i.e. 5 transactions created or 5 referrals made). Automatic entry with no point cost incurred.

• 15% off a transaction fee with a cost of 400 points.
• 25% off a transaction fee with a cost of 600 points.
• 50% off a transaction fee with a cost of 1,100 points.
• 100% off a transaction fee with a cost of 2,000 points.
• *Refer a friend x 1 with a cost of 2,500 points.
• Gold Seasonal reward (raffle): One entry per 500 points(i.e. 5 transactions created or 5 referrals made). Automatic entry with no point cost incurred.

*You can use this reward if you need an extra hand to redeem your refer-a-friend reward (i.e. you have referred two friends and need an extra referral to redeem your reward).

• Transactions: Customers earn points for every transaction completed exclusively through the Kabayan Remit mobile or web app (points are not awarded for telephone transactions). The number of points earned per transaction depends on the customer’s tier level.

• • No tier: 110 points per transaction.
  • Bronze tier: 120 points per transaction
  • Silver tier: 125 points per transaction.
  • Gold tier: 135 points per transaction.

• Referrals: Customers earn points for each successful referral. A referral is considered successful when the referred friend makes their first transaction and is fulfilled.
  • No tier: 110 points per referral.
  • Bronze tier: 120 points per transaction
  • Silver tier: 125 points per referral.
  • Gold tier: 135 points per referral.

• Transactions: Customers earn points for every transaction completed exclusively through the Kabayan Remit mobile or web app (points are not awarded for telephone transactions). The number of points earned per transaction depends on the customer’s tier level.
  • No tier: 100 points per transaction.
  • Bronze tier: 110 points per transaction
  • Silver tier: 115 points per transaction.
  • Gold tier: 125 points per transaction.

• Referrals: Customers earn points for each successful referral. A referral is considered successful when the referred friend makes their first transaction and is fulfilled.
  • No tier: 100 points per referral.
  • Bronze tier: 110 points per transaction
  • Silver tier: 115 points per referral.
  • Gold tier: 125 points per referral.

• Points can be redeemed for rewards based on the customer’s tier.
• Points required for redemption will be deducted from the customer’s point balance.
• Points are non-transferable and will be forfeited if the Kabayan Remit account is closed for any reason.
• Redeemable rewards cannot be exchanged for cash or other forms of compensation.
• Only one reward can be redeemed per transaction. The highest applicable reward will automatically be applied to your next transaction.

• Bronze, Silver and Gold tiers are eligible for seasonal rewards.
• Customers can earn raffle entries based on their activity:
  
  • One entry per 500 points accumulated.
  • One entry per five transactions created.
  • One entry per five referrals made.
• No points will be deducted for the seasonal rewards raffle entry.
• Silver tier members will have a chance to win Bronze-tier seasonal rewards. Gold tier members will be eligible to win both Bronze and Silver tier seasonal rewards in addition to the Gold tier rewards as they progress through the tiers.
• Seasonal rewards will be announced periodically, and winners will be notified through their registered contact information.
• By participating in the Rewards Program, customers who win seasonal rewards or raffles draw consent to have their names announced on social media.
• Occasionally, the reward prize may be out of stock or unavailable. In such cases, we reserve the right to substitute it with a similar item.
• If you are a lucky winner, you have 30 days from the time we contact you to claim your prize. Failure to do so will result in forfeiture of the prize.

• The prize is available for any airport in Canada or the UK with direct flights to Manila. The prize is for one person on a roundtrip in economy class. The prizewinner may choose the date they wish to fly, but it must be within one year from the raffle draw date.
• The cost of the flight may not exceed CAD$1,500 (if the winner is a customer in Canada) or GBP£900 (if the winner is a customer in the UK). If the flights on the desired date exceed this amount, the winner may change dates to find a flight that meets these criteria or the company will contribute this amount to the purchase of the ticket, and the winner is responsible for making up any shortfall.
• Kabayan Remit will not be responsible for rebooking or repurchasing plane tickets if the prizewinner misses their chosen flight due to their own fault or negligence, or for reasons not attributable to Kabayan Remit.
• The prizewinner may opt to convert the prize to cash with the equivalent amount of CAD$1,500 (if the winner is a customer in Canada) or GBP£900 (if the winner is a customer in the UK).

• Points earned through the Program will expire when the Program is refreshed. The Program is refreshed every 90 days. Please make sure to redeem and use your rewards within this 90-day period.
• Kabayan Remit reserves the right to terminate the Program or alter the point expiry policy with due notice to participants when it expires.

• Participant data will be used in accordance with Kabayan Remit’s Privacy Policy.
• Data will be protected and not shared with third parties without consent, except as required by law

• Kabayan Remit reserves the right to disqualify any participant from the Program if fraudulent activity or abuse is suspected.
• Kabayan Remit reserves the right to modify, suspend, or terminate the Program at any time without prior notice.
• Kabayan Remit is not responsible for any technical issues that may prevent participants from earning or redeeming points.
• The terms and conditions will dictate how points are calculated. In the event of a system error or similar issue, Kabayan Remit reserves the right to recalculate or adjust a user’s points under these terms.
• Kabayan Remit reserves the right to use and display your full name during the live raffle. If you prefer not to participate, you can opt-out by contacting our customer support.

To the extent permitted by law, Kabayan Remit expressly excludes all conditions, warranties and terms which may be implied by statute, common law or equity.

Furthermore, Kabayan Remit shall not be liable for any delay or failure to process transactions, redeemable or seasonal rewards due to circumstances beyond Kabayan Remit’s control, including but not limited to electrical and telecommunication disruptions, natural calamities, civil disturbances, or any lawful order issued by duly constituted authorities in the jurisdiction where executed.

This does not affect our liability for death or personal injury arising from our negligence, nor our liability for any fraudulent misrepresentation, nor any other liability which cannot be excluded or limited under each countries’ applicable law.

These Terms and Conditions are for the sole benefit of the Parties and their respective successors and permitted assigns, and nothing herein, express or implied, is intended to or will confer upon any other person any legal or equitable right, benefit or remedy of any nature whatsoever under or by reason of these Terms and Conditions.

The failure of Kabayan Remit to enforce any right or provision of these Terms and Conditions shall not constitute a waiver of the same right or provision.  No waiver of the provision of these Terms and Conditions shall be effective unless it is made in writing and signed by the Remitter and Kabayan Remit.

In the event any provision of these Terms and Conditions is determined to be void or unenforceable, such determination shall not affect the remainder of these Terms and Conditions, which shall continue in force.

These Terms and Conditions shall be subject to and interpreted in accordance with the laws of the country in which the Remitter has registered for Kabayan Remit’s services:

• For Remitters registered in the United Kingdom, the laws of England and Wales. The Parties irrevocably submit to the jurisdiction of the courts of England and Wales.
• For Remitters registered in Canada, with the exclusion of Quebec, the laws of Ontario and the relevant federal laws of Canada. The Parties irrevocably submit to the exclusive jurisdiction of the courts in the province of Ontario.
• For Remitters registered in the province of Quebec in Canada, the laws of Quebec and the relevant applicable federal laws of Canada. The Parties irrevocably submit to the exclusive jurisdiction of the courts in the province of Quebec.
• For Remitters registered in the United States, the laws of the State of New York. The Parties irrevocably submit to the jurisdiction of the courts of the State of New York.

By participating in the Kabayan Remit Rewards Program, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
